How long does it take to change the passport after marriage registration and how to do it correctly?
Registration of marriage is a happy event in the life of every girl. True, along with the new marital status, in most cases, the surname also changes. Together with the surname, the passport, driver's license and any other official documents must be changed.
If you have time to wait with your insurance and medical records, then your main ID should be changed right away. When this needs to be done, for how long and in which body - described in this article.
Reason for changing the passport
The Family Code of the Russian Federation contains article 32. It regulates formal family relations, that is, the article states that after the registration of marriage, both spouses have the right to change their surnames or keep their old names. Change of surname is an optional attribute of marriage. In addition, double surnames are also not prohibited by law.
Thus, only a change in the surname of a married citizen, or the use of a double surname, can serve as a reason for replacing a passport after registration of a marriage.
How long does it take to replace?
Most Russians believe that changing an identity card is too long a procedure that takes a lot of time and effort. Fortunately, this is very different now. The replacement of this document takes place in the same mode as the replacement of a passport upon loss, upon reaching age or upon its initial issue.
In Russia, there is a Decree of the Government of the Russian Federation of 08.07.1997 N 828 (as amended on 18.11.2016) "On the approval of the Regulations on the passport of a citizen of the Russian Federation, a sample form and description of the passport of a citizen of the Russian Federation." This document regulates the timing of issuing a new passport. Thus, a new passport will be ready at the place of residence no more than 10 days later, and not at the place of residence, for example, at the place of residence - no later than 30 days from the date of acceptance of the documents.
When do you need to submit documents?
After registering a marriage, a citizen who has changed his surname has a thirty-day period to submit the relevant documents for change. But there is a nuance. The fact is that on the day of registration of the marriage, the spouse's surname will already be changed, and the registry office employees will stamp the passport with the date of registration. In this regard, the passport with the current surname turns out to be invalid and cannot serve as an identity document.
Referring to the same Resolution “On Approval of the Regulations on the Passport of a Citizen of the Russian Federation ...”, documents for a replacement passport must be submitted no later than thirty days from the date of marriage registration.
After thirty days, the document becomes invalid, which amounts to incidents with a forged passport. Be careful.
Penalties
If documents have not been submitted within thirty days, a citizen with a new surname will be fined from 2,000 to 3,000 rubles, and living with an incorrect passport in Moscow and St. Petersburg is punishable by a fine of 3,000 to 5,000 rubles.
A citizen can avoid administrative liability in two cases:
- if the submission of documents is delayed by no more than 7 working days;
- if there is evidence that caused the untimely appeal.
If the citizen does not pay off the fine issued to him, he can wait for a more severe punishment, for example, arrest for 15 days, doubling the amount of the fine, or bringing him to 50 hours of community service. These penalties are applicable for 2 years from the date of delay in payment.
In addition, due to a lack of passport replacement or late payment of a fine, accounts may be seized or a ban on leaving the country imposed.
Documents required to replace a passport
As with any replacement of the identity card, the institution is provided with the necessary list of documents.
- Application for replacement of the passport of the established form (form No. 1P). The application must already contain a new surname.
- Old passport, which now needs to be replaced.
- Two photographs of the fixed size 35x45 mm. If you need a temporary identity card, then 3 photos are handed over.
- Receipt for payment of state duty or payment receipt details.
- Documents required for marks in the spouse's new passport. Military registration documents, birth certificates of children under 14 years old.
And also a marriage registration certificate is added to this list. It is on its basis that the surname will be changed.
Where to submit documents?
Usually, the FMS is responsible for replacing the identity card. They are divided into three divisions: at the place of residence, place of stay and at the place of appeal.
Now the MFC and the Unified portal of state and municipal services are gaining more and more popularity. If you have to go to the FMS and the MFC on your own and personally submit documents, then thanks to registration on the Unified Portal of State and Municipal Services, you can do everything online.
Personal visit
If you submit the documents yourself, then you need to come to the required authority and submit the documents in person. You will then be told when to pick up your finished passport.
During a personal visit, you can ask for a temporary ID card, which will indicate your information, he will be assigned a number, and the employee will stick your photo and indicate the date until which this certificate will be valid.
Usually, a temporary ID is issued for 10 days. Government officials are obliged to issue it to you at the first request, there are practically no cases of refusal to issue it.
Online
If you apply through the Unified Portal of State and Municipal Services, you will need to appear in person only to obtain a passport, taking the original documents with you.
Replacement of passport
In addition to the identity card of the Russian Federation, a citizen who has changed his surname must also replace other documents, including a foreign passport.
Of course, the issue with a foreign passport is not as strict as with an all-Russian one or, for example, with rights. A spouse who has changed his surname may not change his passport until its expiration date, if there are no planned trips to visa countries, the main condition in all questionnaires is to indicate that this is a maiden name. Cases with EU countries or other countries where the entry procedure is stricter is more difficult. For example, when applying for a visa, you attach a copy of the documents of the passport of the Russian Federation, and if the data differs, then the documents will not be accepted from you.
If a citizen nevertheless decided to change his passport, it will be necessary to pay a receipt for an old or new (biometric) passport.
What to do when immediately after registration you want to go on a honeymoon trip? There are no problems here, all documents are drawn up on old documents, and they change after arriving back. Even if for some reason the honeymoon trip is delayed, you can provide tickets or a voucher for accommodation to cancel the fine.
Driver's license
It is not necessary to change the driver's license either. If during the check you attach a marriage certificate to your valid rights, then there will be no problems.
Replacing other documents
In fact, it turns out that there are a lot of replacement documents. A new passport must be submitted to banks and tax authorities, as well as to a new landlord if you are renting an apartment. It is necessary to provide a new document for work, and so on. Therefore, before changing your surname, weigh the pros and cons, and then make a decision.
